AERLUX ILUMINACIÓN, S.L. , as the party responsible for the website, hereinafter the CONTROLLER, makes this document available to users in order to comply with the obligations laid down in Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE), and to inform all users of the website of its terms of use.

Any person accessing this website assumes the role of user, undertaking to strictly observe and comply with the provisions set out herein, as well as with any other legal provision that may be applicable.

2. USERS

Accessing and/or using this AERLUX portal confers the status of user, who accepts, from the moment of such access and/or use, the General Terms of Use set out herein. These terms apply irrespective of any General Terms of Contract that may, where applicable, be binding.

3. USE OF THE PORTAL

aerlux.es provides access to a wide range of information, services, programs or data (hereinafter, “the contents”) on the Internet belonging to AERLUX or to its licensors, to which the user may have access.

The user assumes responsibility for the use of the portal. That responsibility extends to any registration required to access certain services or contents. In such registration the user shall be responsible for providing truthful and lawful information.

As a result of this registration, the user may be provided with a password for which they will be responsible, undertaking to use it diligently and confidentially.

The user undertakes to make appropriate use of the contents and services that AERLUX offers through its portal and, by way of example but not limitation, not to use them to:

  • Disseminate content or propaganda that is racist, xenophobic, illegally pornographic, that condones terrorism or that infringes human rights.

AERLUX reserves the right to withdraw any comments and contributions that infringe respect for personal dignity, that are discriminatory, xenophobic, racist or pornographic, that harm young people, children, public order or public safety, or that, in its judgement, are not suitable for publication.

In any event, AERLUX shall not be liable for the opinions expressed by users through forums, chats or other participation tools.

4. DATA PROTECTION

AERLUX complies with the guidelines of the personal data protection legislation in force and ensures the correct use and processing of the personal data of the user.

To that end, alongside every personal data collection form in the services the user may request, the user will be informed of the existence and acceptance of the specific conditions governing the processing of their data in each case.

AERLUX also states that it complies with Law 34/2002 on Information Society Services and Electronic Commerce and will request the consent of the user for the processing of their e-mail address for commercial purposes on each occasion.

AERLUX, either in its own right or as assignee, owns all the intellectual and industrial property rights in its website, as well as in the elements contained therein (images, sound, audio, video, software or texts; trade marks or logos, colour combinations, structure and design, selection of the materials used, etc.).

All rights reserved. The reproduction, distribution or public communication, including making available, of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, is expressly prohibited without the authorisation of AERLUX.

The user undertakes to respect the intellectual and industrial property rights owned by AERLUX. The user may view the elements of the portal and even print, copy or store them exclusively for personal and private use.

6. EXCLUSION OF WARRANTIES AND LIABILITY

AERLUX shall not be liable, under any circumstances, for damages of any nature that may be caused by errors or omissions in the contents, unavailability of the portal or the transmission of viruses or malicious programs in the contents, despite having adopted all the technological measures necessary to prevent this.

7. MODIFICATIONS

AERLUX reserves the right to make, without prior notice, such modifications as it deems appropriate to its portal, and may change, remove or add both the contents and services provided through it and the way in which they are presented or located on its portal.

8. LINKS

Should aerlux.es provide links or hyperlinks to other Internet sites, AERLUX shall exercise no control whatsoever over those sites and contents.

Under no circumstances shall AERLUX assume any liability for the contents of any link belonging to a third-party website, nor shall it guarantee the technical availability, quality, reliability, accuracy or truthfulness of any material or information contained in those sites.

9. RIGHT OF EXCLUSION

AERLUX reserves the right to deny or withdraw access to the portal and/or to the services offered, without prior notice, to those users who fail to comply with these terms.

10. GENERAL PROVISIONS

AERLUX shall pursue any breach of these terms, as well as any improper use of its portal, by bringing all the civil and criminal actions to which it may be entitled by law.

11. AMENDMENT OF THESE TERMS AND DURATION

AERLUX may amend the terms set out herein at any time, and such amendments shall be duly published on the website.

The validity of those terms shall depend on their display and they shall remain in force until they are amended by others duly published.

12. APPLICABLE LAW AND JURISDICTION

The relationship between AERLUX and the user shall be governed by the Spanish legislation in force.

Any dispute shall be submitted to the Courts and Tribunals of the city of Zaragoza.
